MILWAUKEE, Wis (CIVIC MEDIA) – Suspended Milwaukee County Judge Hannah Dugan’s lawyers stated Thursday that the case should be dismissed, claiming Dugan’s courtroom actions are protected by “absolute immunity”.
The judge’s attorneys filed a memorandum that argued Dugan’s federal prosecution is improper due to it violating the 10th Amendment, which states power not expressly given to federal government by the U.S. Constitution is then reserved by the states or the people.
Dugan is charged with helping an undocumented man evade arrest by federal agents in her courtroom. If convicted, the judge could face up to six years in prison.
Federal prosecutors have until Monday, June 9 to respond to the call of dismissal.
